Does this meet the emergency standard?
Courts grant ex parte orders only when waiting for a standard hearing would allow serious, irreversible harm. If your situation doesn't meet this threshold, a standard RFO is still an option — and may serve you better.
The standard is higher than most people expect.
Ex parte means the court hears your side without the other party present. California courts grant this only when immediate harm or serious irreparable injury would result from the delay, or the other party is unlikely to appear if given notice.
Filing when the threshold isn't met can damage your credibility with the judge on this case and in future hearings.
